KEY COLLECTIVE WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT FOR PARTICIPATION IN #AREUIN? CARD ACTIVITIES

The KEY Collective (“KEY Collective”) is a New Hampshire non-profit corporation that provides a database of activity options and programs (soccer teams, running clubs, etc.) (“Activities”) provided by Seacoast area sport and activity organizations (“Partner”) to allow K-12 youth from low-income families throughout NH's seacoast region to connect with such Activities in the community.  KEY Collective assists the K-12 youth with connecting them to participating Partner programs and provides qualification status of said youth’s financial need as appropriate to Partner and other Activity organizers with no red tape and no social stigma attached.

I as the parent/guardian of a minor child seeking to utilize the KEY Collective Partner programs enter into the below agreement and acknowledge that it is a prerequisite for participation in the services offered by KEY Collective.  

I understand that KEY Collective does not organize the Partner activities and any activities are organized by and any scholarship funding comes from the Partner(s) and not KEY Collective. I understand that Partners are third party groups in partnership with KEY Collective that are not controlled by KEY Collective and are merely partnered with KEY Collective in an attempt to make activities more accessible and financially feasible for those interested. 

In consideration for my child being given permission to access KEY Collective’s services and participate in KEY Collective Partner programs, I hereby agree to RELEASE, INDEMNIFY, HOLD HARMLESS, AND COVENANT NOT TO SUE KEY Collective and its administrator, owner, employees, workers, volunteers, agents, officers, and the owners and any lessees of the premises of KEY Collective, from all injury and liability to my child, personal representatives, assigns, successors and heirs, from any and all loss or damage, and any claim or demands therefore on account of injury to my child or property or resulting in the death of my child arising out of, or related directly or indirectly to, any incident or activity that occurs as a result of participation with a third party in partnership with KEY Collective.

I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement, I, or anyone on my child’s behalf, makes a claim against KEY Collective, I will indemnify, defend, and hold harmless KEY Collective from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as a result of such claim, whether the claim is alleged to have been caused by the negligence of KEY Collective or otherwise. Further, any claims or disputes relating to this release or my child’s participation with KEY Collective services shall be venued in the Rockingham County Superior Court in the State of New Hampshire, and that New Hampshire Law shall govern this agreement.    

I recognize and understand that it is my responsibility to confirm that any organization I sign my child up with as a Partner is a valid Partner with KEY Collective and is listed on their website and accepts the #areuin? card.  

I understand and acknowledge that I have had a chance to ask any questions regarding this waiver of liability and hold harmless agreement and have made a good faith effort to contact KEY Collective at (603) 231-1513 or Info@keycollective.org if there is anything I did not understand.

I ACKNOWLEDGE THAT I have read the foregoing WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT, understand it and acknowledge it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this RELEASE for full, adequate, and complete consideration, fully intending to be bound by same. 

I certify that the information provided in this application is true and complete to the best of my knowledge and belief. I understand that giving false statements or failing to provide complete information can be grounds for termination from The KEY Collective.
